Master Service Agreement (MSA)

Bennett Motorsports Support (BMS) – Master Service Agreement
Bennett Motorsports Support (BMS) operates as a premium motorsports concierge and logistics provider. All services, including trackside support, logistics, storage, and vehicle access, are provided on an "As-Is" basis. BMS is not a mechanical authority, and no warranty of safety or performance is expressed or implied. Clients agree to indemnify and hold BMS harmless from any and all claims arising from the services provided. This agreement limits the total liability of BMS and requires the client to assume all risks associated with motorsports activities

Arrive & Drive Agreement

Arrive & Drive Program Terms
This agreement governs the use of BMS-owned vehicles. By participating in the Arrive & Drive program, the client agrees to operate the vehicle in a responsible manner and according to all operational expectations set by BMS. The client assumes full financial responsibility for any and all damage to BMS-owned vehicles while the vehicle is under the client’s care or operation.

Damage Responsibility Addendum (Critical)

Damage Responsibility & Strict Liability Addendum
Strict Liability: The client is strictly liable for any damage to the BMS vehicle regardless of fault. This includes damage caused by third-party incidents.
Vehicle Value & Total Loss: All vehicles are assigned a pre-agreed "Agreed Value." A vehicle is considered a "Total Loss" if repair costs reach 70% of the Agreed Value, or at the sole discretion of BMS.
Loss of Use: In addition to repair costs, the client is responsible for daily downtime/loss of use charges while the vehicle is being repaired or replaced.
Insurance: Client liability is not limited by any insurance coverage BMS may maintain. Full payment for damages is due per the terms and enforcement policies of BMS.

Client Vehicle (Concierge) & Transport

Client-Owned Vehicle Support & Transport
For clients utilizing BMS for concierge, storage, or trackside support of their own vehicles: BMS provides logistics and support only. BMS assumes no responsibility for mechanical failure or safety certification. The client retains full responsibility for the vehicle's condition and authorizes BMS to make minor adjustments at the client’s sole risk.
Transport Coordination: BMS acts solely as a coordinator for vehicle transport and assumes no carrier liability.

Liability Waiver & Assumption of Risk

Liability Waiver & Release
The client acknowledges that motorsports involve significant risks, including the risk of serious injury, death, and property damage. By engaging BMS services, the client voluntarily assumes all such risks.
The client hereby waives, releases, and discharges BMS from any and all claims or causes of action arising from participation in trackside events or use of BMS services

Payment & Cancellation Policy

Payment, Deposits, & Cancellations
All service deposits are generally non-refundable. The remaining balance for any service or event must be paid in full prior to the start of the event. Cancellation windows and credit policies are strictly enforced as defined in the service order.
